As a general rule, an employer can fire an employee at will. This means that the employer can terminate the employee’s employment for any reason, with or without cause.
However, there are some exceptions to this rule. For example, an employer can’t fire an employee for exercising their rights under the National Labor Relations Board (NLRB) or Fair Labor Standards Act (FLSA) laws.
Similarly, an employer can’t fire an employee for refusing to perform an illegal act, refusing to obey an illegal order, or engaging in a peaceful protest. In addition, an employer can’t fire an employee for being a public official, a union organizer, or a whistleblower.
Based on these exceptions, it’s safe to say that Home Depot is an at will employment employer. As long as the employer doesn’t violate any of the employee’s legal rights, they’re free to fire any employee for any reason.
